เป็นประเด็นร้อนในโลกโซเชี่ยลเมื่อวันที่ 2 สิงหาคม 2568 รัฐมนตรีว่าการกระทรวงมหาดไทย รักษาราชการแทนนายกรัฐมนตรี นายภูมิธรรม เวชยชัย ออกแถลงการว่า พื้นที่บริเวณเขากระโดง เป็นกรรมสิทธิ์ของการรถไฟแห่งประเทศไทย (รฟท.) ตามคำพิพากษาของศาลฎีกาและศาลปกครอง ซึ่งพบว่าโฉนดที่ดินออกโดยมิชอบด้วยกฎหมาย และเข้าข่ายถูกเพิกถอนตามมาตรา 61 วรรค 8 แห่งประมวลกฎหมายที่ดิน

ลักษณะเอกสารที่ดินจำนวน 5,083 ไร่ ดังกล่าวแบ่งออกเป็น 6 กลุ่ม ได้แก่

1. โฉนดที่ดิน 700 ราย

2. ไม่ปรากฏในแผนที่ 129 แปลง

3. ทางสาธารณประโยชน์ 53 แปลง

4. ที่ดินมีการครอบครอง 19 ราย

5. ที่ดิน น.ส.3 ก. 7 ราย

6. ที่หลวง 1 ราย

รมช.มหาดไทย นายเดชอิศม์ ขาวทอง สรุปกรณีที่ดินเขากระโดงยืนยันเป็นที่ดินของรัฐ และกรมที่ดินมีอำนาจเพิกถอนได้ทันที ซึ่งจะดำเนินการตั้งแต่วันที่ 2 สิงหาคม 2568 เป็นต้นไป โดยมีผลภายใน 40 วัน

It was a hot topic on social media on August 2, 2025, when the Minister of the Interior, acting as Prime Minister, Mr. Phumtham Wechayachai, issued a statement stating that the Khao Kradong area is the property of the State Railway of Thailand (SRT.)

According to the judgment of the Supreme Court and the Administrative Court, which found that the land title deed was issued illegally and is subject to revocation under Section 61, Paragraph 8 of the Land Code

The characteristics of the 5,083 rai of land documents are divided into six groups:

1. Title deeds (700 items)

2. 129 plots not shown on the map

3. Public roads (53 items)

4. Land held (19 items)

5. NS3 Kor. land (7 items)

6. Government land (1 item)

Deputy Minister of Interior, Mr. Decha Isara Khaothong, summarized the Khao Kradong land case, confirming that it is government land and that the Land Department has the authority to immediately revoke it, which will be implemented from August 2, 2025, with an effective date of 40 days.

ฉะนั้นแล้ว “สนามช้าง อินเตอร์เนชั่นแนล เซอร์กิต” ไม่ได้ถูกรื้อถอนทั้งหมดอย่างที่เข้าใจกัน จากเหตุการณ์นี้คาดการณ์บทสรุปที่ได้ 2 กรณี คือ

1. หากพื้นที่ทับซ้อนดังกล่าวต้องถูกตัดออกไป สนามช้างฯ เซอร์กิต ทำการปรับเลย์เอ้าท์สนามใหม่ และเปลี่ยนทางเข้าจากประตู 1 ฝั่งด้านหน้าสนามบอล ไปเข้าประตู 2 ทางด้านหลังฝั่งถนน 226 (ระหว่าง แยกภัทรบพิตร – แยกกระสัง) แทนได้
2. ทำสัญญาเช่าระยะยาว มีระยะเวลานาน 20-30 ปี และสามารถต่ออายุสัญญาเช่าได้ หรือตามระยะเวลาที่การรถไฟกำหนดซึ่งสิทธิดังกล่าวเรียกว่า “สิทธิการเช่า”

Therefore, the Chang International Circuit was not completely demolished as previously believed. From this incident, two possible conclusions can be predicted

1. If the overlapping area has to be removed, Chang International Circuit will adjust the layout of the stadium and change the entrance from Gate 1 on the front side of the football field to enter the gate

สถาบันพัฒนาองค์กรชุมชน (พอช.) กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ (พม.) เกี่ยวกับโครงการแก้ไขปัญหาประชาชนที่อยู่อาศัยในที่ดินของการรถไฟแห่งประเทศไทย (รฟท.) จำนวน 35 จังหวัด 300 ชุมชน 27,084 ครัวเรือน ทำสัญญาเช่าคราวละ 30 ปี โครงการดังกล่าวเกิดขึ้นจากมติคณะรัฐมนตรีจึงมอบหมายให้ พอช. เป็นเจ้าภาพดำเนินโครงการตลอดระยะเวลา 5 ปี ภายใต้งบประมาณ 7,718 ล้านบาท

และปัญหาใหญ่สุดที่รัฐบาลไทยยังไม่พูดถึง คือ “หากไม่ได้จัดการแข่งขันโมโตจีพีปี 2026 ตามปฎิทิน” เนื่องจากการรื้อถอนปรับปรุง สนามช้างฯ เซอร์กิต รัฐบาลไทยจะถูกทาง ลิเบอร์ตี้ (ดอร์น่า สปอร์ต) ผู้จัดการแข่งขันฟ้องร้องเรียกค่าเสียหายประมาณ 6.4 ล้านยูโร หรือประมาณ 237 ล้านบาท

ซึ่งตามตารางแข่งขันโมโตจีพี “ไทยจีพี 2026” เป็นสนามแรกเปิดฤดูกาล

พาย้อนอดีตกว่า 100 ปี เรื่องการเวนคืนที่ดินเมื่อปี 2462 สมัยสมบูรณาญาสิทธิราชย์ เพื่อใช้เชื่อมต่อกับทางรถไฟเดิมที่มีอยู่แล้วใน จังหวัดนครราชสีมา ซึ่งการรถไฟแห่งประเทศไทย มีหลักฐานยืนยันว่ามีเอกสิทธิ์ในการถือครองโดย “ศาลฎีกา” และ “ศาลปกครอง” มีคำพิพากษาศาลฎีกาที่ 842-876/2560 คำพิพากษาศาลฎีกาที่ 8027/2561 และคำพิพากษาศาลอุทธรณ์ภาค 3 คดีหมายเลขดำที่ 111/2563 คดีหมายเลขแดงที่ 1112/2563

“วินิจฉัยว่าที่ดินแสดงเขตแผนที่ของการรถไฟ แยกย่อยศิลา ต.เขากระโดง จ.บุรีรัมย์ หลักกิโลเมตรที่ 375+650 เป็นส่วนหนึ่งของพระราชกฤษฎีกา กำหนดเขตสร้างทางรถไฟต่อจากจังหวัดนครราชสีมา ถึงจังหวัดอุบลราชธานี เมื่อวันที่ 8 พ.ย. 2462”

หลังจากนั้นทางกรมที่ดิน กระทรวงมหาดไทย ออกเอกสารชี้แจงจำนวน 3 ฉบับ แจ้งว่า คณะกรรมการสอบสวนตามมาตรา 61 แห่งประมวลกฎหมายที่ดิน มีมติเอกฉันท์ “ไม่เพิกถอน” หนังสือแสดงสิทธิที่ดินบริเวณเขากระโดง ได้ดำเนินการถูกต้องตามข้อกฎหมายทั้งหมด โดยให้ รฟท. ไปพิสูจน์สิทธิในกระบวนการยุติธรรมทางศาลอีกครั้ง

เรียกได้ว่าเป็นกรณีศึกษาปัญหาแบบ “รัฐฟ้องรัฐ” 

บทสรุปเรื่องนี้จะเป็นอย่างไรติดตามกันต่อไป…

After that, the Department of Lands, Ministry of Interior, issued 3 explanatory documents stating that the investigation committee under Section 61 of The Land Code unanimously voted not to revoke the land title deed in the Khao Kradong area, which was carried out in accordance with all legal requirements. The State Railway of Thailand (SRT) will now proceed to verify its rights through the court process

This could be called a case study of the “state suing state” problem.
